Guidelines Regarding Copyright Infringement Claims

Introduction and Purpose

At Emberwake, we deeply value the creative efforts of all content creators, artists, storytellers, and developers who contribute to the ever-expanding realms of fantasy and digital engagement. In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable intellectual property laws, we have established the following policy to address claims of copyright infringement in a respectful and lawful manner.

• Scope of Policy
  This policy applies to all content hosted, displayed, or transmitted through the Emberwake website and affiliated services. This includes, but is not limited to, artwork, lore, in-game visuals, downloadable resources, audio compositions, character designs, and user-submitted material.
• Submitting a Claim
  If you believe that your copyrighted work has been used in a manner that constitutes infringement, you are encouraged to submit a formal notification through our designated inquiry channel. Your request should contain specific information, including identification of the protected work, description of the material in question, and a good-faith statement asserting that use of the content is unauthorized under applicable law.
• Required Elements of a DMCA Notification
  To proceed with any claim, your notification must include the following components:
  • Clear identification of the copyrighted work allegedly infringed;
  • Exact location (URL or section) of the infringing material on our site;
  • A statement affirming that you are the rightful owner or authorized representative of the copyright holder;
  • A declaration made under penalty of perjury that the information provided is accurate and truthful;
  • A verifiable method of contact through which further discussion can occur.
  Incomplete notifications may be disregarded or delayed in review.
• Review & Response Process
  Upon receiving a complete and valid notification, our guardians of legal affairs will initiate a formal investigation. If the claim is deemed legitimate, the alleged infringing content may be temporarily removed, altered, or suspended. A notice will be issued to the content submitter, offering them an opportunity to respond or file a counter-notification where applicable.
• Counter-Notifications
  If the recipient of the claim believes the takedown was incorrect or unjustified, they may submit a counter-notification asserting their rights. This counter-notice must contain sufficient legal grounding and evidence, and will be reviewed by our internal counsel before any action is reversed or further steps taken.
• Repeat Infringers
  Individuals or entities found to repeatedly violate the intellectual property rights of others may be subject to permanent suspension from the platform, loss of access to Emberwake’s community features, or other disciplinary actions deemed necessary by the Ember Council.

We remain committed to balancing the rights of creators and the freedom of our community members to express themselves within the Emberwake universe. Allegations of infringement are treated with utmost seriousness and confidentiality, with each case reviewed through a lens of neutrality, fairness, and respect for legal precedent.
